Thank you for visiting Anjuno.com ("Anjuno"), owned and operated by Anjuno, Inc. ("Anjuno Inc"). Anjuno is a media distribution website that allows artists to post information regarding themselves as well as art owned and/or created by them. It allows fans to easily access this art and pay whatever price they want for it. Unless explicitly stated otherwise, all current, updated and new products and services ("Products and Services"), shall be subject to these General Terms and Conditions of Use ("Terms and Conditions"). Anjuno Inc reserves the right to amend these Terms and Conditions at any time.

Age Requirements:

Individuals under the age of 13 are prohibited from accessing Anjuno without verified parental consent furnished to Anjuno Inc in accordance with the Children's Online Privacy Protection Act of 1998. You hereby represent and warrant that you are 14 years of age or older. Where there is mature or adult content on Anjuno, individuals who are less than 18 years of age or are not permitted to access such content under the laws of any applicable jurisdiction may not access such content. In cases where you have authorized a minor to use the Products and Services, you recognize that you are fully responsible for the conduct, access, and consequences of use by the minor. You acknowledge that some areas of Anjuno may contain material inappropriate for minors.

Indecent Content:

You understand that by using Anjuno, you may encounter content that may be deemed offensive, indecent, or objectionable. You agree to use Anjuno at your own risk and that Anjuno shall have no liability to you for content that may be found to be offensive, indecent, or objectionable.

Termination:

All users acknowledge and agree that Anjuno Inc may terminate your access to the Anjuno should you fail to comply with the Terms and Conditions or any other guidelines and rules published by Anjuno Inc. Any such termination shall be in Anjuno Inc's sole discretion and may occur without prior notice, or any notice. Anjuno Inc further reserves the right to terminate any user's access to Anjuno or for any reason or for no reason at all, in Anjuno Inc's sole discretion, without prior notice, or any notice.

Registration:

Some of Anjuno's Services will require the user to register and provide certain data. Either you or Anjuno may terminate your user registration at any time. You represent that all information you provide during the registration process and at any time thereafter ("Registration Information") will be true, accurate, complete, and current and that you will maintain and promptly update your Registration Information as necessary such that it is, at all times, true, accurate, complete, and current. If you provide any information that is untrue, inaccurate, not current or incomplete, or Anjuno Inc has a reasonable ground to suspect that such information is untrue, inaccurate, not current or incomplete, Anjuno Inc has the right to suspend or terminate your account and refuse any and all current or future use of the Products and Services. The Company may use all Registration Information, subject to Company's compliance with the Company Privacy Policy that can be found here (the "Privacy Policy"). This Agreement includes terms and conditions set forth in the Privacy Policy.

Anjuno, Inc is not responsible for the content of any web sites linked to Anjuno.com. The inclusion of a link does not imply endorsement or approval of the linked website by Anjuno, Inc. Clicking any link on Anjuno.com is done at the user's own risk.

Publishing content:

You hereby acknowledge and agree that you are solely responsible for all materials that you post or publish on Anjuno.com, including without limitation, information, code, data, text, software, music, sound, links, photographs, pictures, graphics, video, messages, files and any other materials ("Content"). You represent, warrant and agree that no Content submitted by you or through your account will violate or infringe upon the rights of any third party, including copyright, trademark, privacy, publicity or other personal or proprietary rights; or contain libelous, defamatory or otherwise unlawful material. You represent and warrant that you have all legal rights necessary to publish any Content on the Web Site or that you own such Content. You agree to pay all royalties and fees owing to any person by reason of any Content you post on Anjuno. You hereby acknowledge and agree that Anjuno shall, at all times, possess the right to refuse to include and/or to cause the removal of any or all of your Content for any reason and at its sole discretion. It is our policy not to permit materials known by us to be infringing to remain on this Web Site. You should notify us promptly if you believe any materials on Anjuno infringe a third party copyright. Upon our receipt of a proper notice of claimed infringement we will respond expeditiously to remove the material claimed to be infringing.

By posting content on Anjuno.com you hereby agree to pay a 15% (fifteen percent) royalty fee directly to Anjuno, Inc on all money paid to you by fans through Anjuno.com.

License of Content:

All Content on Anjuno.com is protected under the Creative Commons Attribution-Noncommercial-Share Alike 3.0 Unported Licensce. Authors and musicians retain all copyrights on their work.

Anjuno Inc claims no ownership interest in any of the Content posted by you on Anjuno, and the copyright to all such Content shall remain with its original owner. However, in order for Anjuno to provide its Service, you hereby grant Anjuno, Inc a limited, royalty-free, worldwide license to use, modify, distribute, display, and promote such Content. This is necessary so that we can re-size or re-encode files so that they appear on the site properly. The license ends as soon as you remove the Content from Anjuno.

Anjuno's Services allow users to download files published by artists. All publishers of such content understand and agree that any user may download this content for free. Anjuno makes no guarantee that users will pay for such content.

Use of Anjuno.com:

By using Anjuno.com you agree not to collect any personal information from any user for any purpose. You agree not to use Anjuno.com in an unlawful manner or in any way that could disable, damage, or impair Anjuno.com. You agree not to use automated scripts to collect information from Anjuno.com. You agree not to post, email, or upload any spam, junk mail, threatening or objectionable material, viruses or other malicious code, unauthorized advertising, or any other material that could harm or annoy anyone or anything. You agree not to use or try to use another user's account without their approval. You agree not to impersonate any person or entity, or otherwise misrepresent yourself as affiliated with another person or entity.

Anjuno.com is intended for personal use only. Use of Anjuno.com and its Services for any commercial business may be subject to additional terms and conditions. By downloading Content you agree that you are authorized to use the files only for personal, noncommercial use. You agree that your download of music files constitutes your acceptance and agreement to these Terms and Conditions. You also agree to the terms of the Creative Commons Attribution-Noncommercial-Share Alike 3.0 Unported Licensce, and that all Content on Anjuno.com is covered by that licensce.

Limitation of Liability:

Anjuno, Inc will in no event be liable to you or any third party for any damages whatsoever arising from your use of Anjuno.com or any of its services. Anjuno, Inc is not also not liable for damages caused by improper use, including the distribution of unlicensed files, by any users of Anjuno.com and its services.

Anjuno, Inc does not represent or warrant that the functions contained in the site will be uninterrupted or error-free, that the errors will be corrected, or that this site or server will be free of viruses or other harmful components. All logos, trademarks, services, and designs are trademarks of the company and may not be imitated, copied, or used, in whole or in part, without written permission of Anjuno, Inc.

The Anjuno Audio Player and all its constituent software are subject to the terms of this Agreement as well. You agree not to copy, tamper with, modify, or reverse engineer the Anjuno Audio Player. You agree not to use the Anjuno Audio Player for any illegal or malicious purpose. Anjuno, Inc is not liable for any unauthorized use of the Anjuno Audio Player.

Failure to exercise any right or provision of this Agreement does not constitute a waiver of that right or provision. Anjuno reserves the right to change, add, or delete portions of this Agreement at any time without notice. Changes will be posted to this page with a new effective date indicated. If you do not agree to this Agreement or any future Agreement, do not use Anjuno. It is your responsibility to check for updates to the Agreement.

DRM:

Artists agree to post no media with DRM (Digital Rights Management) on Anjuno. The file can be downloaded for free, so there is no point to using DRM.
